1. Acceptance of Terms

By registering for an account, accessing, or otherwise using the EdgeCDN infrastructure, dashboard, APIs, or any associated services (collectively, the "Services") provided by EdgeCDN Network Ltd ("EdgeCDN", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these terms, you must not access or use the Services. If you are entering into these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms.

2. Description of Service

EdgeCDN provides a globally distributed Content Delivery Network (CDN), Edge Compute platform, Web Application Firewall (WAF), and DDoS mitigation services. Our platform allows customers to cache static assets, execute serverless functions at the edge, and secure their web applications from malicious traffic.

3. Account Registration and Security

To use our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are solely responsible for safeguarding the password and API keys that you use to access the Services. EdgeCDN cannot and will not be liable for any loss or damage arising from your failure to comply with the above.

4. Acceptable Use Policy (AUP)

You agree to use the Services only for lawful purposes and in accordance with these Terms. You are strictly prohibited from using the Services to:

We reserve the right to immediately suspend or terminate your account without notice or refund if we determine, in our sole discretion, that you have violated this AUP.

5. Billing, Pricing, and Payments

Our Services are provided on a subscription and pay-as-you-go basis, as detailed on our Pricing page. By providing a payment method, you expressly authorize us to charge the applicable recurring subscription fees, as well as any overage charges incurred based on your bandwidth consumption or compute function executions.

All fees are exclusive of applicable taxes, levies, or duties imposed by taxing authorities. Invoices are generated monthly. Failure to pay outstanding invoices within 14 days of issuance may result in the suspension of your Services.

6. Service Level Agreement (SLA)

We are committed to providing a highly available service. Our SLA guarantees a 99.99% monthly uptime for customers on the Enterprise tier. If we fail to meet this SLA, you may be eligible for service credits, which will be calculated as a percentage of your monthly bill. This SLA does not apply to the Developer or Business tiers, which are provided with a best-effort uptime target.

Downtime is defined as a period where the EdgeCDN network is unable to serve cached content from at least 50% of its global PoPs. The SLA excludes downtime caused by scheduled maintenance, factors outside of our reasonable control (force majeure), or your origin server's unavailability.

7. Intellectual Property Rights

We claim no intellectual property rights over the material you provide, cache, or process using our Services. Your profile and materials uploaded remain yours. However, by using our Services to cache or process content, you grant us a worldwide, royalty-free, non-exclusive license to host, copy, transmit, and display that content strictly as necessary for us to provide the Services to you.

The EdgeCDN name, logos, and all related product and service names, design marks, and slogans are trademarks or service marks of EdgeCDN Network Ltd. You may not use them without our prior written consent.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EDGECDN, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

9. Indemnification

You agree to defend, indemnify and hold harmless EdgeCDN and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

10. Termination

You may terminate your account at any time by contacting support or via the billing dashboard. We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
